1. Acceptance of Terms

By downloading, installing, or using Sotto ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

You must be at least 18 years old to use Sotto. By using the Service you represent that you meet this requirement.

2. Description of Service

Sotto is a macOS desktop application that provides an AI-assisted overlay during technical activities, including software engineering interviews. The Service uses third-party AI APIs to analyze screenshots and transcribe audio in real time.

3. Eligibility and Account

You must sign in with a valid Google account to use Sotto. You are responsible for maintaining the security of your account and for all activity that occurs under it. Notify us immediately at sottosupport@gmail.com if you suspect unauthorized access.

4. Acceptable Use

You agree to use Sotto only in ways that are lawful and consistent with these Terms. You specifically agree to:

Accept full personal responsibility for how you use Sotto during any interview, assessment, or evaluation.
Review and comply with the policies of any employer, recruiter, or platform that administers evaluations you participate in. Sotto does not verify whether your use complies with any such policy.
Not use Sotto to gain an unfair advantage in any process that explicitly prohibits external assistance.
Not reverse engineer, decompile, or attempt to extract source code from the application.
Not use the Service to transmit harmful, illegal, or abusive content.
Not attempt to circumvent any usage limits, authentication systems, or billing controls.

We reserve the right to suspend or terminate your account for violations of this section without notice or refund.

5. Subscription, Billing, and Cancellation

Free Trial. New users receive a 7-day free trial with access to all features. No credit card is required to begin the trial. At the end of the trial period, continued access requires a paid subscription.

Pro Plan. The Pro plan is billed at $19.99 per month. Subscriptions renew automatically at the end of each billing period unless cancelled.

Cancellation. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; you will retain access through that date. We do not offer prorated refunds for partial months.

Refunds. All charges are generally non-refundable except where required by applicable law. If you believe a charge was made in error, contact us at sottosupport@gmail.com within 14 days of the charge.

Price Changes. We may change the subscription price upon 30 days' advance notice. Continued use after the notice period constitutes acceptance of the new price.

6. Intellectual Property

Sotto and its original content, features, and functionality are owned by the Sotto team and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the application for personal, non-commercial purposes.

You retain ownership of any content you create or upload. By using the Service you grant us a limited license to process that content solely to provide the Service (e.g., sending screenshots to an AI API for analysis).

7. Third-Party Services

Sotto relies on third-party providers to deliver its features, including OpenAI for AI analysis and Deepgram for audio transcription. Your use of the Service is also subject to those providers' terms of service and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party providers.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SOTTO AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Sotto and its operators from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Assumption of Risk — Employer and Recruiter Consequences

You acknowledge and agree that using Sotto during an interview, assessment, or any evaluation process may violate the policies of the employer, recruiter, staffing agency, or platform administering that process. Such violations may result in consequences including, but not limited to, disqualification from the hiring process, rejection of your application, rescission of any offer of employment, termination of employment, and being banned or blacklisted from applying to that company in the future.

SOTTO EXPRESSLY DISCLAIMS ALL LIABILITY FOR ANY CONSEQUENCES YOU EXPERIENCE AS A RESULT OF AN EMPLOYER, RECRUITER, OR ANY THIRD PARTY DISCOVERING, SUSPECTING, OR DETERMINING THAT YOU USED SOTTO DURING AN EVALUATION. THIS INCLUDES, WITHOUT LIMITATION, LOSS OF EMPLOYMENT OPPORTUNITY, DAMAGE TO YOUR PROFESSIONAL REPUTATION, CAREER HARM, OR ANY OTHER DIRECT OR INDIRECT CONSEQUENCE ARISING FROM SUCH DISCOVERY.

By using Sotto you voluntarily assume all risk associated with potential discovery of your use of the Service and any resulting professional, contractual, or reputational consequences. Sotto makes no representation that its screen-capture exclusion or other privacy features will be effective in all environments, software configurations, or future versions of third-party conferencing tools.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including Sections 8, 9, 10, and 11) will survive.

13. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in New York.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date above. Continued use of the Service after changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
